these terms explain the agreement between you and niko. we've written them to be read, not to hide things in fine print. by creating an account or using niko, you agree to what's here and to our privacy policy, incorporated by reference. if something doesn't sit right, email hello@myniko.app before you sign up.
niko is a wellness presence and connectivity tool. it notices motion in a room using your spare device's on-device computer vision, sends wellness nudges to a designated caregiver when motion patterns suggest a check-in might help, and enables a short two-way video check-in when you choose to accept one.
niko is not a medical device. it does not diagnose, treat, monitor, or respond to medical conditions, and it does not provide medical advice. it is not a substitute for professional care, emergency services, your existing health or medical-alert devices, or human judgment. it is not a fall detector or a security system. niko does not guarantee alert delivery — detection, nudges, and check-ins depend on device, lighting, network, and other factors outside our control. never rely on niko in an emergency. if someone needs urgent help, call 911.
niko is built on consent and dignity. a few things that are always true:
you must be at least 18 years old to create a niko account. by using niko, you represent that you're 18+, have the legal capacity to enter these terms, aren't barred from using the service under applicable law, and will use it only for its intended wellness purpose. if you set up niko for someone you love, you confirm you have their knowledge and consent — niko only works when the person being watched over accepts.
niko signs you in with a secure link sent to your email — no password to remember. keep access to your email secure, since anyone who can open that link can reach your account. you're responsible for the activity under your account and for keeping your contact details current. each account is for one person; don't share it or create accounts for others without their knowledge and consent. tell us at hello@myniko.app if you think someone else has gained access.
by entering a caregiver's phone number, you represent that they are a real person who has agreed to be your niko caregiver, has expressly consented to receive automated wellness notifications by SMS and WhatsApp on your behalf, and has been told the nature, frequency, and content of those messages. you are responsible for obtaining that consent before entering their number; we are not liable for messages sent to a number you entered without proper consent. caregivers may opt out anytime by replying STOP — if they do, you're responsible for updating their contact info. where available, we recommend using niko's built-in caregiver invitation, which lets a caregiver formally accept their role and confirm consent.

we may suspend or close accounts that do these things.
niko is currently in beta. that means it may contain bugs or incomplete features; features may change, be removed, or be added without notice; availability isn't guaranteed; and we may end the beta at any time. by using the beta, you acknowledge these limitations and agree not to rely on niko as your sole safety measure.
niko is free while it's in beta. there is no charge to use niko today, and we don't collect payment or card details during the beta.
we expect to introduce paid subscription plans as niko grows. when we do, we'll show the plans and prices clearly when you sign up and on a pricing page, and we'll give you notice before any charge is ever made. you can decline and keep using whatever remains free.
when a caregiver sets up niko for someone they love, the caregiver is the account owner, and the person being watched over never deals with billing. if that person declines to join, the setup is canceled.
the motion signals, account details, and messages tied to your use belong to you, and we handle them as described in our privacy policy. niko itself — the software, design, name, trademarks, and brand — belongs to The Vulcan Girl LLC and is protected by U.S. and international intellectual-property laws. using niko grants you a limited, non-exclusive, non-transferable, revocable license for its intended personal wellness purpose, and doesn't give you ownership of it.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE VULCAN GIRL LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE VULCAN GIRL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
niko is a wellness connectivity tool used in addition to — not instead of — professional medical care, emergency services, and other safety measures. you assume full responsibility for your safety and the safety of those you watch over.
you agree to defend, indemnify, and hold harmless The Vulcan Girl LLC from claims, damages, losses, and expenses (including reasonable attorney fees) that arise from your entering another person's phone number without their consent — for example, a caregiver's number — or from any claim brought by a person you added about the messages they received through your use of niko. this is the part only you can control, so it's the part we ask you to stand behind.
your use of niko is subject to our privacy policy at myniko.app/privacy, incorporated into these terms by reference.
niko integrates with third-party providers, including messaging delivery, real-time video infrastructure, cloud infrastructure (database and hosting), and email delivery. your use of those services is subject to their own terms and privacy policies, and we're not responsible for their practices.
you may close your account anytime — either from the account deletion feature in the app, or by emailing hello@myniko.app. either path deletes your data the same way: we remove your account and all associated data, including the stored motion signals, in line with our privacy policy. we may also suspend or terminate your account if you violate these terms, if your use poses a risk to other users or the service, or if we discontinue niko; on termination, your license to use niko ends immediately.
these terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.
let's talk first. if you have a concern, email hello@myniko.app — we'll try to resolve things informally. if we can't, disputes will be handled in the courts located in California, unless the law gives you the right to a different venue.
we may update these terms. we'll notify you of material changes by email at least 14 days before they take effect, and update the date above. continued use after the effective date means you accept the updated terms.
